Inmate Education Act

A bill to reduce the recidivism rate in Boys' State by offering prison inmates educations.

Education

1. Whereas the recidivism rate in 2021 in New York State is 43%.

 

2. Whereas the recidivism rate nationwide in 2019 was 52%.

 

3. Whereas the United States has the 3rd highest recidivism rate worldwide.

 

4. Whereas the United States has the second-highest prison population rate worldwide (698).

 

5. Whereas the United States has the highest prison population worldwide.

 

6. Whereas the cost for one prisoner per year is anywhere from $82,000-$447,000.

 

7. Whereas the average undergraduate tuition and fees for a SUNY school is $8,600.

BE IT ENACTED BY LEGISLATE SENATORS VIRTUALLY ASSEMBLED THAT

Glossary of Terms:

Recidivism - the tendency of a convicted criminal to re-offend.

 

Prison population rate - how many people per 100,000 are incarcerated.

 

Undergraduate tuition and fees - the sum of all payments to a college or university for education. (not including room and board).

 

Life Sentence - 50 years or more in New York State.

 

State Prison - Prisons under State jurisdiction, typically for crimes resulting in a sentence lasting a year or more.

Section 1)

1. New York State prisons shall provide college-level educations for willing inmates

i) instructors and curriculums provided by SUNY schools

ii) educations for inmates serving any sentence less than life in prison

2. Prisons may provide these programs

i) through existing areas, or through the creation of new areas if possible,

ii) with materials left to the discretion of the institutions providing the education,

iIi) through online meetings or in-person if desired by the instructor

iv) with a budget of $10,000 per participating inmate.

3. A study will be conducted 10 years from the enactment of this bill to determine its effectiveness in lowering the recidivism rate.

Punishments:

Prisons that do not comply within a year after enactment will be fined according to the discretion of state officials.

Enforcement:

Enforcement will be the responsibility of the New York State Division of Criminal Justice Services.

Enactment:

Inmate Education Act

will go into effect on

August 1, 2022, 4:00:00 AM

Prisons will have the remainder of 2021 and the beginning of 2022 to prepare for these changes and can begin education in the Fall semester.
